Legal Notice: This Privacy Policy is provided as a starting-point draft and should be reviewed and finalized by a licensed attorney before publication. It does not constitute legal advice.
Our Commitment to Your Privacy
Adiosly exists to help people document their most personal wishes. That means you will share information with us that you may not share with anyone else — farewell letters, estate instructions, medical preferences, and family relationships. We take that trust seriously.
This Privacy Policy explains what information we collect, how we use it, who we share it with, and what rights you have over it. We have written it in plain language because the subject matter of our service already requires enough of you without making this harder than it needs to be.
1. Information We Collect
1.1 Information You Provide Directly
When you create an account and use Adiosly, you provide us with:
Account Information
- Name, email address, and password
- Date of birth (to verify eligibility)
- Profile information you choose to add
Planning Content (“User Content”)
This is the core of what Adiosly stores on your behalf. It includes:
- Farewell letters, videos, audio recordings, and final messages (Carta de Adios)
- Funeral, cremation, and ceremony preferences
- Estate and belongings instructions
- Names, contact information, and roles of Designated Recipients (beneficiaries, executors, trusted contacts)
- Financial account information you choose to document (account names, locations — we do not store full account numbers or passwords)
- Medical preferences, advance directive wishes, and related health information you voluntarily provide
- Any other personal content you upload or create through the Service
Payment Information
If you subscribe to a paid plan, payment is processed by our third-party payment processor. Adiosly does not store your full credit card number. We retain only the last four digits, card type, and billing address for account management purposes.
Communications
If you contact us by email or through our support channels, we retain records of that correspondence.
1.2 Information Collected Automatically
When you use the Service, we automatically collect certain technical information:
- IP address and approximate location (country/state level)
- Browser type, device type, and operating system
- Pages visited, features used, and time spent on the Service
- Referring URL and exit pages
- Cookies and similar tracking technologies (see Section 7)
1.3 Information from Third Parties
We may receive limited information from:
- Authentication providers if you use single sign-on (e.g., “Sign in with Google”)
- Payment processors for transaction confirmation
- Analytics services that help us understand how the Service is used
2. How We Use Your Information
We use the information we collect for the following purposes:
To provide the Service
Storing, organizing, and delivering your planning documents and messages — including posthumous delivery to your Designated Recipients — is the core function of Adiosly. Your User Content is used exclusively for this purpose.
To manage your account
Processing your registration, verifying your identity, managing subscriptions and payments, and communicating with you about your account.
To improve the Service
Analyzing usage patterns, identifying technical issues, and developing new features. This analysis uses aggregated or anonymized data wherever possible. We do not analyze the content of your personal planning documents for product improvement.
To communicate with you
Sending account-related notifications, security alerts, product updates, and (if you opt in) marketing communications. You may opt out of marketing emails at any time.
To comply with legal obligations
Responding to valid legal process, enforcing our Terms of Service, and protecting the rights and safety of users and third parties.
To verify death and facilitate posthumous delivery
Upon receiving a verified report of a user’s death, we use account information and Designated Recipient details to authenticate the report and deliver materials in accordance with the user’s instructions.
3. How We Share Your Information
Adiosly does not sell your personal information. We do not share your User Content with advertisers. We share information only in the following circumstances:
With Designated Recipients
Upon verified death or incapacity of a user, we share designated materials with the individuals the user has named to receive them. This is the core delivery function of the Service.
With Service Providers
We share information with third-party vendors who help us operate the Service, including:
- Cloud storage and infrastructure providers
- Payment processors
- Email delivery services
- Customer support tools
- Analytics providers
All service providers are required by contract to handle your information in accordance with this Privacy Policy and applicable law, and are prohibited from using your data for their own purposes.
For Legal Compliance
We may disclose information when required by applicable law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect the safety of any person, prevent fraud, or protect Adiosly’s legal rights.
In a Business Transaction
If Adiosly is acquired, merged, or transfers substantially all of its assets, your information may be transferred as part of that transaction. We will notify users by email and prominent notice on the Service before any transfer takes effect, and you will have the opportunity to delete your account before the transfer.
With Your Consent
We may share your information for other purposes with your explicit prior consent.
4. Sensitive Information
Adiosly’s Service necessarily involves sensitive categories of personal information, including health-related preferences, family and relationship information, financial account references, and information about death and dying.
We apply heightened protections to sensitive information:
- It is stored with encryption at rest and in transit
- Access by Adiosly employees is restricted to those with a legitimate operational need
- It is never used for advertising, profiling, or sale to third parties
- It is not used to train artificial intelligence or machine learning models
5. Data Retention
Active Accounts
We retain your information for as long as your account is active or as needed to provide the Service.
Deleted Accounts
When you delete your account, your User Content is permanently deleted within 30 days. Aggregated and anonymized usage data may be retained indefinitely. Certain information may be retained longer if required by law.
Posthumous Accounts
Following verified death, Adiosly retains account data for [24 months] after completion of posthumous delivery to enable Designated Recipients to access delivered materials. After this period, data is permanently deleted unless a legal representative requests an extension.
Payment Records
We retain transaction records for [7 years] as required by applicable financial regulations.
6. Data Security
We implement industry-standard security measures to protect your information, including:
- Encryption of data at rest (AES-256) and in transit (TLS 1.2 or higher)
- Access controls limiting employee access to personal data
- Regular security assessments and vulnerability testing
- Incident response procedures for potential data breaches
In the event of a data breach that affects your personal information, we will notify you as required by applicable law, and in any case within 72 hours of becoming aware of the breach.
No security system is impenetrable. We cannot guarantee that your information will never be accessed without authorization, and we encourage you to use a strong, unique password and enable two-factor authentication on your account.
